JCEB Annual Health and Welfare Meeting

For the last two days, I have been presenting at the annual JCEB health and welfare conference, which is an annual gathering of employer health plan professionals and government representatives. A few key items emerged from this year’s meeting, listed briefly as follows: – The Obama Administration does not support an administrative delay of the 2014 employer or individual mandate. – The employer penalty guidance will be released in early 2013. DOL Issues Holiday FAQs

Not to be outdone by the IRS, DOL issued today 15 additional FAQs regarding Affordable Care Act compliance issues.  But, wait, there’s more.  The FAQs also address outstanding compliance issues for mental health parity.  Any yet, there’s still even more.  The FAQs address wellness program compliance as well.  It’s a virtual shopper’s paradise for health and welfare professionals today!  We will be hearing more about these FAQs early next year, as they outline guidance DOL intends to issue in early 2011.  For more information see

Insured Nondiscrimination Rule Compliance Delayed

This evening the IRS released Notice 2011-1, exempting insured plans from the new nondiscrimination rules in the Affordable Care Act (and related penalties for non-compliance) until regulations are issued. Further, the notice provides that the regulations are expected to apply to plan years beginning after issuance. Meaning that for calendar year plans, the earliest the nondiscrimination rules should apply is January 1, 2012. It could even be later than that depending on when the IRS issues the nondiscrimination regulations, which is currently expected in Q2 or Q3 of 2011. Additional Annual Limit Waiver Guidance

OCIIO updated its annual limit or mini-med waiver guidance this afternoon.  Among the recent items is guidance concerning model notices that are required to be sent by plan sponsors who obtain an annual limit waiver, along with a fact sheet, consumer information and restrictions on new “mini-med” plans.  Additional information is posted at
